Terms of Service

These terms are a binding agreement between you and Betlifter ("we", "us", "our") for the use of flan games: the website flan.games and every game, feature and service on it, including Flan Trivia, Flan Tarot and horoscopes, Flan Predictions, La mesa, Talk to Flan, Squish King Flan, Shibuya Arcade Flan, Plinko Flan, Flan Kart, Flan Tower, the community chat, the referral and invitation program, the free-play email verification and flan club (together, "flan games" or the "Service").

1. How you accept these terms

• Clickwrap acceptance. The first time you visit (and again whenever we publish a new version) we show a "Before you play" notice. Ticking the boxes confirming you are 18+ and that you accept these Terms and the Privacy Policy, and pressing a button to continue, is your electronic signature and acceptance. The same applies when you tick the acceptance box to leave your email, create an account or buy a flan club pack.
• Proof. We keep a record of each acceptance (version, choices, date and time, device id, and the IP address and browser it came from) as evidence, as described in the Privacy Policy.
• If you do not agree, do not tick the boxes and do not use flan games.
• These Terms incorporate the Privacy Policy and the Cookie Policy.

2. Not a casino. Nothing here is worth money

• flan games is an arcade for entertainment. It is not a casino, not gambling, not betting, not a sweepstakes, not a contest for prizes and not a lottery. No game accepts a wager and no game awards a prize of value.
• Flan Coins (FC), Flan Points, streaks, scores, records, trivia levels, prediction results, kart times, cosmetics and any other virtual item have no monetary value and cannot be bought, sold, exchanged, withdrawn, redeemed for cash or anything of value, gifted or transferred. They are a limited, revocable, personal licence to use them inside the Service, not property, and we may change, reset or remove them.
• Shibuya Arcade Flan and Plinko Flan use game mechanics similar to arcade or casino games purely as a simulation. Paying for flan club never buys coins, spins, odds, luck or outcomes, and never changes the results, which are identical for every player.
• Flan Predictions is a free, social forecasting game. You cannot stake anything on a prediction and you win nothing of value; questions about sports, markets or crypto prices are trivia, not betting tips nor financial or investment advice.
• Anyone offering to buy, sell or trade coins, accounts or results is breaching these terms and is likely scamming you.

3. Eligibility

• You must be 18 or older (or the age of majority where you live, if higher) and legally able to enter into this agreement. You confirm your age in the "Before you play" notice. We may ask for verification and we close accounts of minors as soon as we detect them.
• You are responsible for complying with the laws of the place you access flan games from. If games with virtual currency, simulated casino mechanics, tarot or online forecasting are restricted where you are, do not use those features.
• You may not use flan games if you are located in, or are a national of, a country or region subject to comprehensive sanctions, or if you are on a sanctions list, or where the Service would be unlawful.

4. The games and features

We may add, change, limit, suspend or remove any game or feature, and run tests with different versions, at any time.

5. Free plays, email verification and our CRM

• Games are free to try. After a number of completed games on a device (currently 3) we ask for your email and send a 6-digit code to verify it. After more games (currently 7) we ask you to get a flan club pass to keep playing without limits. We can change these numbers at any time.
• When you leave your email you must accept these Terms and the Privacy Policy. Your email, name (if you give it), device id, games played, language, invite codes and verification status are stored in our customer database ("CRM") so we can verify you, run your access, prevent abuse, support you and, only if you opt in, send you news.
• Service emails (verification codes, account and purchase messages) are part of the Service. Marketing emails require your separate, optional consent and every one includes a way to unsubscribe.
• Do not try to bypass the limits (for example with multiple devices, emails, scripts or by clearing data to get extra plays in bad faith).

6. Your account

• Keep your login details safe; you are responsible for activity on your account.
• One account per person. No bots, exploits, scripts or automated means to earn coins, points, plays or referrals, and no selling, renting or sharing accounts.
• The information you give us must be true and kept up to date.
• You can close your account at any time from your settings or by writing to us.

7. Acceptable use

You agree not to: break any law; infringe anyone's rights; cheat, exploit bugs, or tamper with the games, servers or security; reverse-engineer or scrape the Service except as the law expressly allows; upload malware; harass, threaten or impersonate anyone; manipulate the AI features to produce unlawful, harmful or sexual content involving minors, or to extract system instructions or other people's data; or use flan games for real-money gambling, wagering on our results, trading of virtual items, money laundering, or any commercial purpose we have not authorised in writing. We may investigate and take any action we consider appropriate, including removing content and reporting to authorities.

8. AI features (King Flan, La mesa)

• Talk to Flan and La mesa use a large language model provided by a third-party AI provider (currently Anthropic) to generate King Flan's replies. You are talking to an AI, not a person.
• AI output can be wrong, incomplete, outdated or inappropriate. It is entertainment, not professional, medical, psychological, legal or financial advice. Verify anything important elsewhere.
• King Flan remembers short facts and a summary of your conversations to personalise future chats. Do not share sensitive information (health, religion, sexual life, political views, ID or card numbers, passwords) or other people's personal data. You can ask us to delete your AI memory.
• Messages are processed by the AI provider to produce the reply under its commercial terms, which do not allow it to use them to train its models. We apply usage limits and safety filters and may refuse or end a conversation.
• In La mesa, what you write is shown to the other people at your table. Don't post anything you wouldn't want them to see.

9. Play safe

flan games is a game, not a way to make money. Take breaks, set limits, and pause or close your account at any time from your settings. If play stops being fun, or you feel you are spending too much time or money, stop and, if you need it, seek help from a professional or a local help line.

10. flan club passes and payments

• Payments are for adults only. Only people 18 or older (or the age of majority where they live, if higher) may buy a flan club pass, using a payment method they are authorised to use. By paying you confirm this. If we learn a pass was bought by a minor or with a payment method used without permission, we cancel it and refund it to the original payment method, and we close the account.
• flan club is optional. It is sold as one-time passes: Pack Flan, US$4.99 for 1 month and Pack King, US$9.99 for 3 months (prices may be shown in local currency and include or exclude taxes as indicated at checkout). A pass does not renew automatically unless the checkout clearly says it is a subscription and you agree to that. If you buy again while a pass is active, the time is added.
• A pass unlocks unlimited play, premium games and cosmetics. It does not buy Flan Coins, luck, odds, prizes or anything of monetary value.
• Payments are processed by Stripe or Mercado Pago under their own terms; we never see your full card number. Prices may change for future purchases.
• Right of withdrawal / cooling-off. If you are a consumer in the EU, EEA, UK or another place granting a cooling-off period for digital services, you have 14 days to withdraw. Because a pass gives immediate access, by completing the purchase you request that it starts immediately and acknowledge that you lose the right of withdrawal once the service has been fully provided; if you withdraw within the period after partial use, we may deduct the proportional value. In Argentina you can revoke an online purchase within 10 days (Ley 24.240, art. 34, and the "botón de arrepentimiento", Res. 424/2020) by writing to us; in Brazil you have 7 days (CDC, art. 49). Wherever a cooling-off right exists by law, we honour it.
• Otherwise, passes are non-refundable except where required by law or in case of a service failure attributable to us. Flan Coins are never refundable because they have no value. To request a refund, write to privacy@flan.games.

11. Your content and the licence you give us

You keep ownership of what you post (chat messages, names, prompts, journal notes, shared cards). By posting, you grant Betlifter a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, process (including with our AI provider to generate replies), display, adapt and distribute that content to operate and promote flan games. Private content (like your tarot journal or AI memory) is used only to provide the feature to you. You are responsible for your content and confirm you have the right to post it. We may moderate, remove or refuse any content.

12. Intellectual property

King Flan, the flan characters, the flan games name, logos, artwork, music, game designs, questions and this site are the property of Betlifter or its licensors, protected by trademark and copyright. You may share memes, results and win cards generated by the site for personal, non-commercial use as long as the flan games mark stays visible; that is the only licence we grant. All other rights are reserved. Copyright or misuse reports (including DMCA-style notices with the work, the infringing URL, your contact details and a good-faith statement): ip@flan.games.

13. Community rules

In chat, tables, comments and shared content: be kind; no hate, harassment, threats or sexual content; no links, promotion or trading; no real-money gambling talk; no personal data of others. Live chat is pre-moderated and moderators may remove content or ban accounts without notice. Report problems to ip@flan.games.

14. Third-party services

flan games relies on third parties such as Supabase (database and authentication), Netlify (hosting), Stripe and Mercado Pago (payments), our email provider, our AI provider and public data feeds for sports fixtures and prices. Your use of those services may be subject to their own terms, and we are not responsible for their acts, omissions, outages or content, nor for third-party sites we link to.

15. Assumption of risk

You use flan games voluntarily and at your own risk. You understand it is entertainment with a virtual currency of no value, that outcomes are random or generated by software, that AI replies can be wrong, and that any money you choose to spend on flan club is not an investment and returns nothing of monetary value.

16. Disclaimer of warranties

To the fullest extent permitted by law, flan games is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and that the Service will be uninterrupted, secure, error-free or free of harmful components. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you, and statutory guarantees that cannot be excluded (for example under the Australian Consumer Law or EU/UK consumer law) remain.

17. Limitation of liability

To the fullest extent permitted by law, Betlifter and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill, virtual items or balances, time spent, or interruptions, arising out of or relating to flan games, whether based on contract, tort, negligence, strict liability or otherwise.

Cap. Our total aggregate liability for all claims relating to flan games will not exceed the greater of (a) what you paid us for flan club in the twelve months before the event giving rise to the claim, or (b) fifty US dollars (USD 50). Because virtual items have no monetary value, no claim may be based on their loss. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as for death or personal injury caused by negligence, fraud, gross negligence or wilful misconduct, or your mandatory rights as a consumer.

18. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Betlifter and its owners, employees and suppliers from claims, damages, losses and expenses (including reasonable legal fees) arising out of your content, your breach of these terms, or your violation of any law or third-party right. This section does not apply to consumers where local law forbids it.

19. Suspension and termination

We may suspend, restrict or terminate your access, remove content, or close your account, with or without notice, where we reasonably believe you breached these terms, for abuse, fraud, risk to others, or where required by law. Where the law requires it, we will tell you the reason and how to contest it. If we close your account without cause while a paid pass is active, we refund the unused part. You may stop using flan games and close your account at any time. Sections that by nature should survive termination survive.

20. Disputes: informal resolution, then arbitration

Before starting any formal proceeding, contact us at privacy@flan.games and try in good faith to resolve the dispute informally for at least 30 days. If it is not resolved, to the fullest extent permitted by the law that applies to you, disputes will be resolved by final and binding individual arbitration, and you and Betlifter waive any right to a jury trial and to participate in a class, collective or representative action. Where arbitration or this waiver is not permitted by the law of your country of residence (for example for consumers in the EU, EEA, UK, Quebec, Brazil, Argentina, Mexico or Australia), it does not apply to you. Either party may still go to small-claims court or seek injunctive relief for intellectual-property misuse.

21. Governing law and venue

These terms are governed by the laws applicable to Betlifter's place of establishment, without depriving you of the protection of the mandatory rules of the country where you live. Subject to section 20, the courts of Betlifter's place of establishment have jurisdiction, except that if you are a consumer you may always bring proceedings in, and may only be sued in, the courts of your place of residence where your law gives you that right.

22. Region-specific terms

• EU / EEA / UK. Nothing in these terms limits your statutory rights as a consumer, including conformity of digital content and services and the right of withdrawal in section 10.
• United States. Section 20 applies to the extent permitted by the Federal Arbitration Act and state law. California users: under Civil Code §1789.3 you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210. New Jersey and other state residents: any limitation or exclusion does not apply to the extent prohibited by your state's law.
• Canada / Quebec. Quebec consumers are not bound by the arbitration and class-action waiver in section 20, and the Consumer Protection Act prevails over any inconsistent term.
• Australia / New Zealand. Our services come with guarantees that cannot be excluded under the Australian Consumer Law or the Consumer Guarantees Act; sections 16–18 apply only to the extent permitted.
• Argentina. Se aplica la Ley 24.240 de Defensa del Consumidor: el contrato se interpreta a favor del consumidor, tenés derecho de revocación de 10 días y el tribunal competente es el de tu domicilio. Cualquier cláusula que limite tus derechos se tiene por no escrita en lo que la ley lo prohíba.
• Brasil. Aplica-se o Código de Defesa do Consumidor (Lei 8.078/1990): direito de arrependimento de 7 dias e foro do seu domicílio. Cláusulas abusivas são nulas.
• México. Aplica la Ley Federal de Protección al Consumidor; podés acudir a la PROFECO.
• Other countries. Wherever local consumer law gives you rights that these terms would otherwise limit, local law prevails.

23. Changes to these terms

We may update these terms. The version and date at the top show the latest one. For material changes we will ask you to accept the new version through the "Before you play" notice before you keep playing, and where required by law we will give you advance notice. If you do not accept, stop using the Service and you can close your account; we will refund any unused paid time if the change materially reduces what you paid for.

24. General

• Severability. If any provision is unenforceable, the rest stays in force and that provision is limited to the minimum extent necessary.
• No waiver. Our failure to enforce a right is not a waiver of it.
• Assignment. You may not assign these terms; we may assign them to an affiliate or successor, without reducing your rights.
• Entire agreement. These terms, with the Privacy and Cookie policies, are the entire agreement between you and Betlifter about flan games.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
• Language. The English version governs, except where the law of your country requires a version in your language to prevail. Summaries in other languages are for convenience.
• No partnership. These terms do not create any partnership, agency or employment relationship.
